Agreement to These Terms

These Terms & Conditions govern your use of the Guntersville Bass Guides™ website, booking system, guided fishing services, communications, and related services.

By using our website, submitting a booking, purchasing a service, or otherwise doing business with Guntersville Bass Guides™, you agree to these Terms & Conditions and any additional policies or conditions presented during the applicable booking or purchase process.

If a specific booking, payment, Gift Card, promotion, or service displays additional terms at the time of purchase, those specific terms also apply.

Guided Fishing Services

Guntersville Bass Guides™ provides guided fishing trips, instructional electronics and sonar services, and other fishing-related services offered through our website or directly by our team.

Trip availability, captain availability, trip length, species, pricing, seasonal offerings, and other service details may vary. The information displayed during the booking process at the time a reservation is made controls that booking.

A booking is not considered confirmed until the required booking information and applicable payment or deposit have been successfully received and the reservation has been confirmed by our booking system or staff.

Captains and Trip Assignment

Guntersville Bass Guides™ may assign a qualified captain based on availability, trip type, scheduling requirements, customer requests when applicable, and other operational considerations.

A particular captain is not guaranteed unless the booking specifically identifies that captain as part of the confirmed reservation.

Captain assignments may occasionally need to change because of illness, mechanical issues, emergencies, weather, scheduling conflicts, or other circumstances outside our reasonable control. When necessary, we may assign another qualified captain to provide the booked service.

Pricing, Deposits and Payments

Current trip pricing and the amount due at booking are displayed during the booking process. Prices are subject to change for future bookings but will not retroactively change the confirmed price of an existing reservation unless the customer requests a change that affects the price.

Certain bookings require a deposit. Unless otherwise stated during checkout, the remaining balance is due in accordance with the payment instructions for the assigned captain or service.

Available payment methods may include cash, debit or credit card, Venmo, Cash App, PayPal, and eligible pay-over-time providers. Available methods may vary depending on the trip, captain, booking type, and payment amount.

Payments processed electronically may be handled through third-party payment providers such as Square, Stripe, PayPal, Klarna, Afterpay, or other authorized processors. Use of those payment services may also be subject to the provider’s own terms and privacy practices.

Rescheduling and No-Shows

Customers should contact Guntersville Bass Guides™ as soon as possible when a scheduling issue arises.

Any more specific cancellation, rescheduling, promotional, Gift Card, or special-event terms displayed at checkout will apply to that particular booking.

Weather and Fishing Conditions

Fishing is an outdoor activity, and conditions can change quickly. Rain by itself does not necessarily result in a cancellation. Decisions regarding weather, lightning, severe storms, unsafe boating conditions, or other conditions affecting a trip are made with safety as the priority.

Guntersville Bass Guides™ and the assigned captain reserve the right to delay, modify, reschedule, relocate, shorten, or cancel a trip when conditions are considered unsafe or operationally impractical.

Optional Weather Guarantee

Certain eligible bookings may offer an optional Weather Guarantee. When purchased, the specific Weather Guarantee terms shown during booking control.

The Weather Guarantee fee itself is non-refundable. The protection applies only as described during checkout and does not mean that ordinary rain automatically cancels a fishing trip.

Fishing Results

Guntersville Bass Guides™ provides professional guided fishing services and makes reasonable efforts to provide customers with a productive and enjoyable experience.

Fishing results can be affected by weather, water conditions, fish behavior, seasonal patterns, fishing pressure, customer ability, and other factors that cannot be completely controlled.

No specific number, size, or species of fish is guaranteed unless expressly stated in writing as part of a particular service or promotion.

Customer Responsibilities and Safety

Customers are expected to follow reasonable safety instructions provided by their captain and to behave in a manner that does not create an unreasonable risk to themselves, the captain, other passengers, equipment, or other persons on the water.

Customers are responsible for obtaining any fishing license legally required for their trip unless specifically stated otherwise.

Parents and guardians are responsible for children traveling with them, including ensuring that children have properly fitted safety equipment when required.

A captain may terminate or modify a trip when a customer’s behavior creates an unsafe situation or materially interferes with the safe operation of the boat.

SMS / Text Messaging Terms

Guntersville Bass Guides™ offers optional transactional text messaging to help customers manage their bookings and receive important trip information.

Email and Other Communications

Customers may receive transactional email communications necessary to manage a booking, including confirmations, payment information, trip preparation, scheduling changes, reminders, and other service-related information.

Transactional communications that are reasonably necessary to perform a requested service are separate from optional marketing communications.

Gift Cards, Certificates and Promotions

Gift Cards, trip certificates, promotional certificates, discounts, special offers, and similar products may be subject to additional conditions shown at the time of purchase, issuance, or redemption.

Promotional products may have eligibility requirements, valid dates, availability restrictions, or other limitations. The terms associated with the specific promotion or Gift Card control its use.

Website Use

You may use this website for lawful personal purposes related to learning about, contacting, or booking Guntersville Bass Guides™.

You may not:

• Attempt to interfere with the operation or security of the website.
• Access restricted systems or information without authorization.
• Use automated methods to abuse or overload the website or booking system.
• Submit false, fraudulent, or misleading booking information.
• Use the website or its content for unlawful purposes.

Intellectual Property

Website content, branding, photographs, graphics, text, logos, booking-system presentation, and other original materials are owned by Guntersville Bass Guides™ or used with permission unless otherwise indicated.

Nothing in these Terms grants permission to copy, reproduce, republish, distribute, or commercially exploit protected content without authorization.

Third-Party Services and Links

Our website may link to or interact with third-party services such as payment processors, lodging providers, fishing-license providers, mapping services, social networks, financing providers, or other websites.

Those third parties operate under their own terms, policies, availability, and practices. Guntersville Bass Guides™ is not responsible for the independent acts, omissions, content, or policies of third-party providers.

Limitation of Liability

To the fullest extent permitted by applicable law, Guntersville Bass Guides™ will not be responsible for indirect, incidental, special, or consequential damages arising from website use, third-party services, communication delays, weather disruptions, fishing conditions, or circumstances outside our reasonable control.

Nothing in these Terms is intended to exclude or limit any right or liability that cannot legally be excluded or limited.

We may update these Terms & Conditions when our services, booking system, technology, policies, legal obligations, or business practices change.

The current version will be posted on this page with its effective date. Changes apply prospectively unless applicable law requires otherwise.

Customer Feedback, Testimonials and Trip Media

Feedback, ratings, comments, testimonials, reviews, photographs, video, and other trip-related content voluntarily submitted to Guntersville Bass Guides™ may be used for legitimate business, website, social media, advertising, promotional, and marketing purposes.

Photographs and video taken by Guntersville Bass Guides™ or its captains during guided trips are business-created trip media. To the extent permitted by applicable law, Guntersville Bass Guides™ retains all rights it holds in that media and may use, reproduce, edit, publish, display, distribute, and otherwise use it for website, social media, advertising, promotional, and marketing purposes. No additional customer approval is required for those uses except where applicable law requires otherwise.

Photographs or video voluntarily provided to Guntersville Bass Guides™ by a customer may also be used with submitted feedback or other trip-related content for the purposes described in this section.

By voluntarily submitting feedback or other customer content, the customer grants Guntersville Bass Guides™ a non-exclusive, royalty-free, perpetual license to use, reproduce, edit for length or clarity, publish, display, and distribute that material in connection with our business and marketing. No additional compensation or separate approval is required for uses permitted by this section, except where applicable law requires otherwise.

When appropriate, we may identify published feedback using the customer’s first name, first name and last initial, captain, trip type, trip date, or general location. We may correct spelling or grammar and may shorten feedback for presentation, but we will not materially change the meaning of the customer’s statements.

Customers may contact us to request that we stop using particular feedback or media in future materials. We cannot guarantee removal from materials already printed, distributed, shared with third parties, cached, or otherwise published outside our direct control.

Privacy

Our collection and use of personal information is also governed by our Privacy Policy .

Governing Law

These Terms & Conditions are governed by the laws of the State of Alabama, without regard to conflict-of-law principles, except where applicable federal law controls.
